  • On May 21, 2026 the Office of the Ombudsman ordered Marcoleta to file a counter-affidavit on plunder under Republic Act 7080, indirect bribery under Article 211 of the Revised Penal Code, and violation of Presidential Decree 46, in a complaint by the Ombudsman Field Investigation Bureau alleging he accepted P75 million in undisclosed campaign donations on January 6, 8, and 9, 2026.
  • The complaint identifies three donors, each charged as co-respondents: former Quezon City representative Michael Defensor (P30 million), Joseph Espiritu (P25 million), and Aristotle Viray (P20 million). The Ombudsman frames the aggregate P75 million as a "gift" under the plunder statute, made on three separate occasions.
  • The complaint stemmed from a Commission on Elections investigation into Marcoleta's alleged non-disclosure of these donations in his Statement of Contributions and Expenditures for the May 2025 election cycle.
